**Description**:
This role is responsible for delivering excellence in commercial contract negotiation, effective influencing and managing stakeholders up to Ex-Co level, acting as the point of contact for customers and suppliers on contractual matters, ensuring timely review, approval and reconciliation of variations.
This role transitions from a pre-sales contract negotiation focus to an in-life contract management focus on the successful closure of an opportunity.
- Review, development, or identification of appropriate contracting model and terms & conditions, managing stakeholder review and approvals.
- Discuss, draft, review and negotiate the terms of business contracts with customers and suppliers
- Provide redlined recommendations and work alongside legal counsels, negotiating with commercial and purchasing stakeholders
- Maintain contractual records and documentation of all contract correspondence, contractual changes, status reports and other documents.
- Provide guidance on contract matters to project managers or other operational staff.
- Work with Risk Management Department / Finance to coordinate contractual insurance & bak guarantees requirements.
- Ensure that signed contracts are communicated to all relevant parties to provide contract visibility and awareness, interpretation to support implementation.
- Handle contractual change management
- Support & oversee compliance monitoring (service level agreement, milestones, deliverables, invoicing etc.)
**Technical / professional qualifications/experience**:
- Influencing and managing large corporate customers and senior stakeholders.
- Proven experience with contract drafting (commercial clauses), evaluation, negotiation and execution
- Proven experience in managing the in-life commercial facets of a complex contract
- Proven experience in a customer facing environment / negotiation
- Proven experience dealing with non-disclosure agreements, sales / purchasing agreements, sub-contracts, consulting agreements, licensing agreements, master agreements.
- Understanding of construction industry, and preferably mining sector
- Solid communication & stakeholder management up to C level
- Advanced Microsoft Office suite skills
- Quantitative first degree or postgraduate business qualification
- IACCM accreditation would be considered an advantage
