As the steward for digitally enabling Australia’s health system, the Agency plays a key role in coordinating national engagement, delivery, and adoption of digital health to facilitate person‑centred, connected healthcare. Our responsibilities span national digital health services and systems, including My Health Record, Electronic Prescriptions, and the 1800Medicare App.
About the Role
The Legal Services and Privacy Branch provides trusted, high‑quality legal advice to the Agency Executive and staff across a broad range of complex matters. The Branch comprises two closely aligned teams—Commercial Law and Corporate Law—and delivers practical in‑house legal services across commercial law, information and privacy law, employment law, statutory interpretation and administrative law.
Responsibilities
As a Senior Lawyer in the Commercial Law team, you will:
* Provide accurate and pragmatic legal advice with limited supervision, including drafting and reviewing complex ICT and software agreements, advising on large‑scale procurements, intellectual property arrangements and confidentiality agreements.
* Work closely with internal clients, other Australian Government agencies and external legal services providers.
* Ensure compliance with the Legal Services Directions 2025.
* Support Principal Lawyers across a broad range of legal matters.
* Manage external legal services provider engagements and budgets.
* Build strong relationships with internal and external stakeholders.
Skills and Experience
* Minimum 5 years' post‑admission experience, including substantial experience as a Government lawyer.
* Strong expertise in commercial law, including ICT and software agreements, procurements, intellectual property and confidentiality arrangements.
* Demonstrated ability to provide clear, practical and timely legal advice on complex matters with limited supervision.
* Proven experience building effective relationships with internal clients, government stakeholders and external legal services providers.
* Admission as a legal practitioner of the High Court or the Supreme Court of an Australian State or Territory, holding (or eligible to obtain) a Government restricted practising certificate.
* Strong organisational skills, with the ability to manage competing priorities, meet deadlines and operate effectively in a fast‑paced environment.

Eligibility
Australian citizenship is mandatory. Candidates must be able to obtain and maintain a national police clearance and the required Baseline security clearance, with the ability to attain a higher‑level clearance if needed.

Applicants rated as suitable will be placed in a merit pool that may be used to fill similar ongoing or non‑ongoing positions throughout the Agency for up to 18 months.
