Senior Associate – Labour, Employment & Workplace Safety
Our Labour, Employment & Workplace Safety group provides advice and representation to employers on all aspects of the employment relationship. The team is recognised as a leader in employment, industrial relations and workplace safety law.
We have a team of over 25 lawyers in 3 Australian offices (Sydney, Melbourne, Brisbane). Currently 3 partners and 11 lawyers in the Melbourne team. The Melbourne team focuses on health, sport, construction, banking, education, government and public sector work.
We pride ourselves on being skilled lawyers who look after clients and work collaboratively. Partners serve as mentors who promote and encourage development at all levels.
About the role
You will work on advice, transactional and litigation matters across employment, industrial and safety issues. The work is complex, challenging and often requires quick turnaround; you will be supported and given many opportunities to grow.
You will have opportunities to work in a team and also work autonomously. No two days will be the same; you may advise on corporate transaction employment issues one day and conduct a workplace health and safety investigation the next.
What does the role involve?
* Representing employers in disputes such as unfair dismissal, discrimination and general protection claims.
* Advising and representing employers in substantial workplace health and safety investigations and prosecutions.
* Responding to regulator investigations (e.g., Fair Work Ombudsman) and prosecutions.
* Advising on novel and complex employment queries.
* Conducting workplace investigations on bullying, discrimination, sexual harassment.
* Negotiating, drafting and advising on employment related documents including contracts, executive arrangements, service agreements, workplace policies.
* Advising on discipline and termination of employment.
* Litigating matters in State and Federal Courts, Tribunals and Commissions; utilising mediation and conciliation.
* Advising on strategic compliance to achieve client outcomes.
* Providing employment law support on commercial and transactional issues: mergers, acquisitions, share sale arrangements, corporate restructures, transfer of business/employment, post‐employment restraints, non‐compliance with legal and regulatory matters.
* Developing and delivering internal and external training on employment and work health and safety matters.

Ideally you will have 5+ years PAE experience within a commercial law firm; public sector experience is also favourable.
