Grade: Clerk Grade 7/8

Location: Parramatta (Hybrid)

Employment Type: Ongoing

This is an opportunity for an experienced lawyer (ideally 3+ PQE) who is keen to continue or develop their career in regulatory decision making, complex disputes and administrative law. The role involves assisting Principal and Presiding Officers in the conduct of Disciplinary Proceedings for Building Commission NSW under various statutory licensing and registration schemes.

About the role

The delegates who conduct Disciplinary Proceedings for Building Commission NSW consider a wide range of professional misconduct allegation against licensed tradespeople, building companies, engineers and registered certifiers.

Delegates may impose a range of penalties after finding a person has engaged in misconduct including:

* Impose monetary penalties up to $220,000
* Implement simple/complex licence conditions
* Whether to suspend or cancel building licences of both small and large licensed or registered entities

The Senior Associate will assist Principal and Presiding Officers in conduct of Disciplinary Proceedings which are similar to those conducted by NSW Civil and Administrative Decisions Tribunal in its administrative and equal opportunity jurisdiction.

This role will suit a lawyer with several years working for a regulator or in administrative law, criminal law or litigation/disputes. The person should also have an interest in criminal/consumer/regulatory law and practice and demonstrate strong skills in statutory and factual analysis and an ability to respond to and deal with complex submissions.

In this role, you will:

* Review and consider referred briefs of evidence concerning misconduct
* Draft notices to show cause with respect to misconduct under licensing and registration schemes
* Consider complex submissions and responsive evidence and research and resolve legal and factual contentions
* Draft written reasons for decisions for consideration by relevant delegates
* Supervise registry staff and Associates in carrying out other functions involved in conduct of disciplinary proceedings
* Work collaboratively with internal stakeholders including investigators, inspectors, and solicitors, as well as external stakeholders, including barristers, police, traders and consumers other project work as required

To be successful in this role:

* You must be a lawyer with 3+ years PQE or have extensive relevant regulatory decision‐making experience, and the ability to resolve nuanced legal and factual contentions
* You must have strong analytical and written drafting skill
* You must have superior communication skills and the ability to express complex issues in a concise and logical manner

Salary Grade 07/08, with the base salary for this role startingat $113574 base plus superannuation
