Overview

As Legal Counsel – Consumer Products & Processing you will be a key member of the legal team supporting this division, with a particular focus on Mastercard Prepaid Management Services in the Asia Pacific region.

Prepaid Management Services is a global prepaid card program services manager offering end-to-end program management services, including transaction processing, cardholder servicing, fraud monitoring, card and collateral design, card manufacture and card distribution. Prepaid card products include travel cards, gift cards, corporate cards and ticketing solutions across a number of different countries in Asia Pacific, North America, South America, Europe, Middle East and Africa. Our largest market is Asia Pacific where we have programs in Australia, New Zealand, Japan, Korea and India.

You will serve as a trusted business partner and a key member of the regional legal team. The role will be based in Sydney (St Leonards office and remotely) and you'll report to the Senior Managing Counsel, Consumer Solution, Core Payment (based in the UK) who has global legal responsibility for these divisions. The role also has a dual reporting into the Regional Senior Managing Counsel for Australasia.

Core Responsibilities Of This Role Are As Follows

* Participate as a key member of the Consumer Solutions & Processing legal team based in Asia Pacific driving innovation and growth of the products and services we offer.
* Entity management and working with our third-party provider to support company secretarial matters within the Asia Pacific region.
* Work closely with and advise the Compliance and Regulatory Affairs teams (and other key stakeholders) to ensure compliance with all applicable regulatory compliance and licensing requirements and Group policies and procedures, including providing advice with respect to legal requirements relating to the provision of financial services, privacy, trade practices, corporations and companies law, anti‐money laundering and counter‐terrorism financing.
* Work closely with the business' Product and Sales teams to advise on and support our, and our customers' products and services development & design, including end‐to‐end considerations to bring the products and services to market.
* Manage the engagement of, and the legal services provided by, external counsel to ensure efficiency, quality of services and cost‐effectiveness.
* Advise key stakeholders of upcoming legislative developments and their potential impact on the business units and operations.
* Ensure the business is provided with accurate, commercial and timely legal services.
* Prepare, review and negotiate distribution agreements and other customer agreements.
* Prepare, review and negotiate agreements with third‐party issuers, suppliers and other potential vendors and strategic alliance partners.
* Draft and review cardholder terms and conditions, marketing materials and other consumer‐facing collateral including Product Disclosure Statements, terms and conditions and Financial Service Guides.
* Review and provide legal advice on tender and RFP documents.
* Liaise with relevant departments to ensure legal and other risks have been identified and appropriate courses of action have been taken.
* Provide and interpret legal information, design & conduct training and disseminate appropriate legal requirements to stakeholders.
* Work closely with other stakeholders within Mastercard (e.g. Privacy, IP, Public Policy, Litigation, Anti-Trust and Employment teams).
* Advise and assist other parts of the Global Consumer Solutions division and Mastercard generally in respect of various commercial, strategic and product development projects.

All About You

* Bachelor of Laws or equivalent degree with current Australian practising certificate.
* In‐house experience in a leading organisation or within private practice, with a proven track record in financial services, payments, regulatory compliance, contract negotiation and drafting.
* Experience covering multiple jurisdictions, multiple large projects and competing priorities.
* Excellent relationship management and communication skills.
* The ability to identify and balance risk with results.
* Ability to provide clear, concise and independent advice (orally and in writing) to senior level management and translate complex legal principles into tangible business consequences.
* Ability to work independently, make practical, timely and solution‐oriented decisions while demonstrating sound judgment throughout.
* Value‐add approach to both internal and external relationships, together with a sense of urgency.
* Strong relationship skills that drive customer‐focused solutions.
* Self‐motivated with a strong sense of team.
