Job Overview

This key role is focused on delivering commercial excellence across our subdivision projects. The successful candidate will be responsible for overseeing all commercial and contractual aspects, ensuring alignment with project budgets, schedules, and profitability targets.

The Commercial Lead will work closely with the Estimating team to support tender submissions, cost analysis, and construction programming. They will also be involved in contract administration processes, including contract evaluation, negotiation, finalisation, and execution in liaison with clients and company legal council.

The ideal candidate will have a strong understanding of commercial and contract management within civil construction, particularly in land subdivision projects. They should possess advanced skills in cost planning, forecasting, budgeting, and commercial reporting, as well as proven ability to manage and negotiate variations, claims, extensions of time, and commercial disputes.

We are seeking a highly skilled professional who can provide commercially sound advice to Project Managers and Senior Leadership. The successful candidate will be able to lead or support the negotiation and resolution of disputes and claims, escalating to the Legal team where required.


Key Responsibilities:

* Commercial Function Oversight: Lead the commercial function across subdivision projects, ensuring alignment with project budgets, schedules, and profitability targets.
* Tender Support: Support the Estimating team with tender submissions, cost analysis, and construction programming.
* Contract Administration: Oversee contract administration processes, including contract evaluation, negotiation, finalisation, and execution in liaison with clients and company legal council.
* Risk Management: Manage commercial risks and opportunities through proactive assessment of contractual obligations, scope changes, and variation claims.
* Project Financial Control: Support the development and ongoing management of project budgets, cost forecasts, and financial reports; contribute to commercial performance reviews and risk assessments.
* Procurement and Negotiation: Support the procurement, negotiation, and administration of subcontractor and supplier agreements in accordance with company policies and project timelines.
* Project Setup: Provide commercial oversight of project setup processes, including project securities, job folder establishment, and subcontractor onboarding.
* Financial Reporting: Support the preparation of monthly cost vs revenue reports, invoicing, and forecasting to ensure strong project financial control.
* Client Communication: Review and respond to client commercial queries and provide commercially sound advice to Project Managers and Senior Leadership.
* Dispute Resolution: Lead or support the negotiation and resolution of disputes and claims, escalating to the Legal team where required.


Required Skills and Qualifications:

* Commercial and Contract Management: Extensive knowledge of commercial and contract management within civil construction, particularly in land subdivision projects.
* Contract Law: Strong understanding of standard forms of contract (e.g. AS2124, AS4000, NEC) and practical experience in contract law, interpretation, and negotiation.
* Cost Planning and Forecasting: Advanced skills in cost planning, forecasting, budgeting, and commercial reporting.
* Negotiation and Dispute Resolution: Proven ability to manage and negotiate variations, claims, extensions of time, and commercial disputes.
* Subcontractor Procurement: Skilled in subcontractor procurement, engagement, and performance management.
* Project Financial Systems: High level of proficiency in project financial systems and tools, including Microsoft Excel and financial tracking software.
* Risk Management: Working knowledge of risk management principles, and ability to identify and mitigate commercial risks across project lifecycles.
* Leadership and Communication: Strong negotiation and influencing skills with the ability to engage effectively with clients, subcontractors, and legal advisors.
* Mentorship: Collaborative leadership style with the ability to mentor, guide and support junior commercial staff.
* Tertiary Qualification: Tertiary qualification in Quantity Surveying, Construction Management, Engineering, Commerce, Law or a related discipline.
* Minimum 10 Years Experience: Minimum 10 years of experience in a Senior Quantity Surveyor or commercial role within the civil construction industry.
* Minimum 5 Years Experience: Minimum 5 years of experience in a commercial leadership role overseeing subdivision or infrastructure projects.
