Senior Investigator - Insolvency & Securities Investigations (APS6)

This position is within the Regulatory Operations Group (ROG). The ROG uses data and intelligence to prioritise resources and a surveillance-based approach to regulatory monitoring. Within the division, the Insolvency & Securities Investigations team investigates alleged personal insolvency offences under the Bankruptcy Act 1966 and alleged breaches of the Personal Properties Securities Act 2009, and prepares briefs for prosecution.

This work supports AFSA’s role as a regulator safeguarding Australia’s credit system.

We are seeking applications from experienced and motivated team members for a Senior Investigator to manage and progress allocated investigations.

Key accountabilities

- Assess referrals and complex enquiries for compliance with the Bankruptcy Act and/or the PPS Act, including recommending appropriate courses of action, evidence collection, exhibit handling, preparing witness statements, conducting recorded interviews and preparing briefs of evidence.
- Investigate alleged Bankruptcy Act and PPS Act offences and, where appropriate, refer cases for prosecution or civil litigation.
- Collaborate with the Commonwealth Director of Public Prosecutions to achieve outcomes, including giving evidence in court.
- Lead and manage caseloads, and maintain case updates in the case management system.
- Assist in developing internal guidance and procedures to support best-practice investigations.
- Respond to enquiries from internal and external stakeholders, including insolvency/trustee associations and government bodies.
- Travel as an expectation of this position.

Qualifications and experience

- Certificate IV in Government Investigations or equivalent, or ability to obtain within 12 months of commencement.
- Tertiary qualifications in Law, Accounting, Commerce or relevant discipline from an Australian institution (or comparable overseas) or demonstrated experience in Insolvency or Finance industries is desirable.

- Adhere to AFSA’s risk management framework and relevant legislation, guiding others to identify and mitigate risks.
