About the Tribunal

The Mental Health Tribunal is an independent statutory tribunal established under the Victorian Mental Health and Wellbeing Act 2022 (the Act). The Tribunal is an essential safeguard under the Act to protect the rights and dignity of people with mental illness. The primary function of the Tribunal is to determine whether the criteria for compulsory mental health treatment as set out in the Act apply to a person. The Tribunal makes a Treatment Order for a person if all the criteria in the legislation apply to that person. The Tribunal also conducts hearings concerning a range of matters related to compulsory treatment for mental illness; electroconvulsive treatment, neurosurgery for mental illness and matters relating to intensive monitored supervision.

Who were looking for

We are seeking Psychiatrist and Registered Medical Practitioner members for sessional positions on the Tribunal. Members will be appointed until 1 September 2030.

Pre-requisites for Tribunal membership

- Psychiatrist members must be registered under the Health Practitioner Regulation National Law in the speciality of psychiatry (non-practicing registration is sufficient).
- Registered Medical Practitioner members must be registered under the Health Practitioner Regulation National Law to practise in the medical profession and have knowledge and experience in relation to the treatment of mental illness.

About the role

Tribunal members conduct hearings as part of a three-member multi-disciplinary division of the Tribunal. Most hearings conducted by Tribunal divisions concern whether or not a treatment order should be made or revoked for an individual patient. Sessional members must be available to sit on hearings at least once per fortnight, however members with additional availability will usually sit more often.

Currently Tribunal hearings are conducted on-line as such these roles are performed remotely. Two full-day member forums per year provide an chance for members to come together in person.

The Victorian Government is committed to ensuring that government boards and committees reflect the composition of the Victorian community. This includes appropriate representation of women, regional Victorians, Aboriginal people, young Victorians, Victoria’s culturally diverse community, the LGBTI community and Victorians with a disability. Individuals with lived experience as a consumer of mental health services, or carer are encouraged to apply.
