About the role:

The Misconduct Disciplinary Advice Unit (MDAU) is a businessunit of the Incident Management Directorate (IMD) and providesexpert advice while managing disciplinary processes arising frominvestigations into allegations of employee misconduct. Thedisciplinary and legislative framework of the MDAU functions isguided by common law principles, The Public Sector Act 2009 and theEducation and Children's Services Act 2019; and relatedreview and appeal processes.

MDAU staff work collaboratively with other departmental units andexternal agencies while acting in an unbiased, impartial mannerwhich considers the rights of individual employees. High-levelcommunications in the form of briefings to the Chief Executive orrelevant delegate are required to set out the courses of actionrecommended and reasonably open in the various phases ofdisciplinary processes.

The Principal Disciplinary Review and Adjudication Officer (DRAO)is accountable to the Manager, Misconduct and Disciplinary AdviceUnit and is responsible for providing leadership, high qualityadvice and guidance to Disciplinary Review and AdjudicationOfficers. The Principal DRAO is also responsible for conductingdisciplinary processes in line with standards and principles ofnatural justice and procedural fairness and within specifiedtimelines, exercised to minimise risk to the safety of children andstudents, the well-being of employees and the reputation andfinancial risk of the Department for Education.

About you:

- Leadership: Experience as a team leader andnetwork building capabilities.
- StrategicJudgement: Ability to provide sound advice to seniorexecutives on complex, sensitive matters.
- Analysis: Experience in high-level researchand analysis of legislation, case law, and industrialinstruments.
- Problem-Solving: Creative thinking withpractical solutions for complex challenges.
- Communication: Exceptional written/verbalskills with professional representation abilities.
- WorkloadManagement: Experience in managing complex caseloadswith competing priorities and tight deadlines.
- ConflictResolution: Skilled in negotiation and high-levelconsultative guidance.
- RiskManagement: High integrity standards with disciplinaryprocess experience.
- SpecialistKnowledge: Knowledge of SA Public Sector frameworksincluding Public Sector Act 2009 and Education and Children'sServices Act 2019.

Qualifications:

Essential: Nil

Desirable:

- Legal or para legal experience.
- Adjudication or complaints resolution.
- Legal services or Law Degree Qualification.

Special conditions:

The successful applicant is required to gain a Department forHuman Services (DHS) working with children check (WWCC) prior tobeing employed which is required to be renewed every five yearsbefore expiry. The incumbent will be required to undertake RRHAN–EC (Responding to Risks of Harm, Abuse and Neglect -Education Care) Facilitator Lead (Masterclass) extended course orthe online (Fundamentals) course which will be required to beupdated every three years.

Remuneration:

- ASO8 $121,107 - 125,679 per annum (1.0 FTE) +superannuation (11.5%) and leave loading
