Regulatory Legal Team Overview
The Regulatory Legal team plays a vital role in providing advice and support to Comcare's regulatory activities, including investigations under the Work Health and Safety Act 2011.
The team delivers expert legal guidance on evidence gathering, issuing statutory notices, and investigation procedures, ensuring that all matters are handled in accordance with relevant legislation and regulations.
Key Responsibilities:
* Providing legal advice and guidance on evidence gathering and investigation procedures.
* Assisting with the preparation of briefs of evidence for criminal prosecutions.
* Collaborating with the Commonwealth Director of Public Prosecution and the Inspector when a prosecution is commenced.
* Facilitating continuous improvement projects and identifying trends and capability opportunities for inspectors.
About the Role
As a Legal Adviser, you will work closely with Senior Legal Advisers in performing their roles and providing client-focused specialist legal and strategic advice and support to Comcare staff on complex legal and policy matters.
You will resolve problems and manage risk effectively, managing your workload in a manner consistent with the APS Values and Code of Conduct, the Legal Services Directions 2017, and internal Comcare procedures.
Requirements
To be successful in this role, you will need to have:
* A strong background in law, with admission as a legal practitioner of the High Court or the Supreme Court of an Australian State or Territory.
* A current Practising Certificate or ability to obtain one within three months.
Eligibility Criteria
In order to be eligible for this role, you must:
* Hold a valid Character clearance (Australian Criminal History Check).
* Be able to provide an Employee Health Declaration.
* Satisfy a six-month probationary period for new engagements.
* Meet the requirements for obtaining and maintaining a Baseline Security Clearance.
