The Commercial/Contract Manager as an AMT Member will promote, encourage and assist senior management and project teams in implementing effective commercial (contractual and financial) practices.Reporting directly to the Alliance Manager, the Project Controls Manager will primarily be responsible for ensuring all managers, Sub-contractors Package Owner and all relevant project staff understand and comply with commercial requirements in the Alliance and major/high risk subcontracts as per policies, procedures and guidelines.Key areas of focus for the Project Controls Manager are ensuring that the Alliance is successful commercially through the control of project contractual issues, including subcontracts, and commercial responses for tenders, whilst contributing with other AMT Members in maximising the business’s profit and budget expectations.Responsibilities and Accountabilities:ResponsibilitiesAttend contract acceptance and contract review meetings as necessary to ensure commercial and contract administration issues comply with contract requirements, policies and proceduresManage commercial issues, minor and major contract disputes when delegated by AMT or Alliance ManagerAssist managers as needed in commercial matters e.g. claims, contractual issues, disputes, preparing subcontract terms and conditions, and setting up administration procedures on and off site with Finance and control ManagerReview and approve acceptance or proposed major / high risk subcontracts and any other subcontract.Lead identification and quantification of Head Contract scope changes and all subsequent negotiations with the ClientNegotiate contract terms and conditions with Project Owner/subcontractors as authorised by senior management in liaison with project management, as per policies, procedures and guidelinesUndertake post-contract completion reviews, analyse results, undertake corrective actionsEnsures the accurate and concise project contract valuation reporting is complete in accordance with accounting cut off dates.Establishes implements and maintains systems in accordance with the divisional requirements and procedures.Reviews project cash flows and identifies divisional cash requirements to Finance ManagerProvide divisional manager and finance department project trend analysis.Provides ongoing development and mentoring of project reporting to Project Managers and Administrators.Finalises project close outs to ensure that project margins are maximised where possible.Provide feedback to estimating departments on completed projects for future reference.Be aware of and ensure compliance with Head Contract conditions and its provisions.Ensure all risk contingency is appropriately recorded and reported.Seek assistance from the Commercial Manager on all potential contract risks/opportunities.Ensures that all financial obligations of the contract are adequately covered, and risk is minimised.Ensure that no subcontractor is engaged on the project prior to the execution of the contract.Ensure that no subcontractor is engaged on the project prior to the execution of the contract.AccountabilitiesStakeholder management: Ensure that stakeholders are actively engaged and that beneficial relationships between the project and the client, subcontractors, community and other external parties are developed and maintainedPeople management: Establish and develop a high-performance team to ensure the project has the capability to achieve targetsFinancial management: Ensure strong contract, commercial and financial risk management, accurate forecasting of both costs and revenue, take corrective action in line with authority and reporting frameworks and maximise the profit margin for the projectWhat we are looking for:We are looking for an individual with a proven track record in commercial and contracts controls providing oversight to complex, large-scale projects. They must have a strong understanding of the importance of commercial and contracts management processes to enable robust traceability and auditability associated with Commonwealth funded projects.They must be willing to actively challenge all members of the AMT regarding performance of their particular areas in order to provide a holistic picture of the overall performance of the Alliance to the Alliance Manager and ALT. They must also have a strong attention to detail in order to provide assurance that the reporting made is accurate and be willing to speak openly in relation to risks and issues identified in performance of the Alliance in order that these can be mitigated or managed accordingly to support the success of the Alliance.The individual must have strong communication skills as they will be required to work closely across the Alliance and the Project Owner.
