This role sits within the NSW Building Commission Division in the Disciplinary Proceedings team.

This is an opportunity for an experienced lawyer (ideally 5+ PQE) who is keen to continue or develop their career in administrative law, criminal law or complex disputes. The role will oversee and determine less complex, and assist more senior delegates in the conduct of more complex, Disciplinary Proceedings for Building Commission NSW under various statutory licensing and registration schemes.

Principal Officers and Presiding Officers are delegates of the Secretary who oversee and determine Disciplinary Proceedings for Building Commission NSW. Disciplinary Proceedings consider a wide range of professional misconduct allegations against licensed tradespeople, building companies, engineers and registered certifiers. Delegates may impose a range of actions and penalties after finding a person has engaged in misconduct including:
* Impose monetary penalties up to $220,000,
* Implement simple/complex licence conditions;
* Whether to suspend or cancel building licences of both small and large licensed or registered entities
The Principal Officers oversee and determine less complex, and assist Presiding Officers in more complex, Disciplinary Proceedings which are similar to those conducted by NSW Civil and Administrative Decisions Tribunal.
The delegates are assisted by Senior Associates, Associates and other Registry staff.
This role will suit an experienced lawyer (ideally 5+PQE) who has extensive administrative law, criminal law and/or litigation/disputes experience. The person should also have an interest in criminal/consumer/regulatory law and practice, demonstrate exceptional skills in statutory and factual analysis, and have a strong ability to respond to and deal with complex submissions.
Your day-to-day
* Review and consider complex referred briefs of evidence concerning misconduct
* Draft notices to show cause with respect to complex misconduct under licensing and registration schemes
* Consider complex submissions and responsive evidence and research and resolve difficult legal and factual contentions
* Draft clear and precise written reasons for decisions for consideration by more senior delegates
* Supervise Senior Associates and other Registry staff in carrying out other functions involved in conduct of disciplinary proceedings
* Work collaboratively with internal stakeholders including investigators, inspectors, and solicitors, as well as external stakeholders, including barristers, police, traders and consumers
* Other project work as required
* Undertake and contribute to, supervision, training and development of more junior staff in the team
To be successful in this role you will demonstrate
* You must be a lawyer with at least 5+ years PQE or have extensive relevant regulatory decision-making experience, and the ability to resolve highly complex legal and factual contentions
* You must have exceptional analytical and written drafting skill
* You must have exceptional communication skills and the ability to express complex issues in a concise and logical manner

Salary Grade 09/10, with the base salary for this role starting at 129,464 base plus superannuation
