Position Summary

Reporting to the Senior Commercial Manager, the Commercial Manager provides support and guidance to the Project Director in the commercial management of the Project. The role is responsible for supporting the guidance of the contracts/commercial team on the project, with a strong emphasis on independent contractual entitlement assessment, disciplined claims and variations management, and high‐quality contractual drafting. The role operates in a complex EPC project environment and is responsible for establishing and articulating Squadron Energy's contractual position before consideration of quantum or pricing. The Commercial Manager works closely with the Project Director, engineering and delivery teams, and the Legal function, but is expected to independently analyse contract compliance, entitlement, and risk exposure, and to produce clear, robust correspondence capable of withstanding scrutiny in escalation, determination, or dispute scenarios.

This is a maximum term position which can be based in any major East Coast city. Regular site travel will be required on either a 1/1 or 2/1 basis (1–2-week site-based, 1 week office based).

Key Responsibilities

* Ensure that all project contracts meet the requirements of the project with respect to scope and execution.
* Work closely with engineering, technical, and project delivery teams to understand site activities and their contractual and entitlement implications.
* In conjunction with Project Managers, support the certification of payments and variations, ensuring entitlement positions are clearly established.
* Formulate and clearly articulate Squadron Energy's contractual entitlement position prior to any detailed review of contractor pricing, quotations, or quantum submissions.
* Produce and administer procedures for contract requirements implementation as required.
* Ensure Company policies associated with contracts are followed.
* Provide guidance on the project process for progress claims for projects and general sales invoicing for projects to ensure timely submission of invoicing and minimise WIP balances.
* Monitor project contracts compliance with contract terms and conditions and maintain and update the project baseline.
* Aid Project Managers in relation to notifications, letters and reports.
* Develop and maintain the project contracts filing system.
* Produce or respond to contractual claims as required, including the negotiation and close of claims.
* Prepare and control sub‐contracts and associated documentation.
* Participate in contract reviews and negotiations.
* Prepare contract variations.
* In conjunction with the Project Managers, be involved in the payment and variation certification process of major subcontractor works and be directly involved in any contractual disputes should they arise.
* Ensure that effective contractual document control processes are adhered to within the business.
* Monitor and review financial data related to contract performance, forecasts, labour, and variation costs, expected Gross Margin and profits, and report any discrepancies as they arise.
* Assist with reporting and processing monthly cost recording and processing.
* Regular visits to site to verify subcontractor performance and to verify contract adherence.
* Close liaison with site team to ensure any issues are managed in accordance with the various contract requirements.
* Establish or maintain relationships with subcontractors, suppliers, and consultants.
* Ensure that stakeholder requirements and project risks are adequately addressed.

Skills and experience

Experience and knowledge

* Minimum ten (10) years' experience delivering complex construction or infrastructure projects.
* Renewable energy sector experience welcome but not required.
* Demonstrated experience independently assessing contractual entitlement, compliance, and risk under major contracts, including the management of variations and extension of time claims.
* Strong experience preparing high‐quality contractual correspondence capable of withstanding scrutiny in determinations, disputes, or escalation scenarios.
* Broad experience across engineering and construction industry contracting practices, including pricing, contract law, planning and scheduling, and government and commercial procurement frameworks.
* Proven ability to exercise independent judgement and problem‐solving, identifying and resolving issues as they arise in complex project environments.
* Experience supporting and working with diverse project teams in the operation of commercial contract management systems, policies, and procedures.
* Ability to build and maintain effective, collaborative relationships with a wide range of internal and external stakeholders.

Skills

* High‐level commercial judgement with the ability to navigate complex deal structures and apply an entitlement‐first approach to claims and variations management.
* Ability to work both autonomously and collaboratively within a diverse, multidisciplinary team.
* Excellent written and oral communication skills, including high‐quality drafting of formal contractual correspondence and the ability to influence outcomes.
* Strong stakeholder management capability, with the ability to positively influence and maintain effective relationships with internal and external parties with competing interests.
* Proactive problem‐solver who uses initiative and analytical thinking to make sound decisions in a fast‐paced construction environment.
* Sophisticated quantitative skills with strong capability across contracts, schedules, documentation management, and financial administration.
* High‐level organisational and priority‐setting skills, with the ability to manage competing deadlines.
* Strong computer literacy, with proficiency in the Microsoft 365 suite fundamental to the role.

Qualifications

* Tertiary qualifications in a related field including Quantity Surveying, Law, Engineering, Construction Management, Project Management or Contract Management.
* Drivers Licence.
