The Trans-Tasman IP Attorneys Board (the Board) administers the regulatory and disciplinary regimes for patent attorneys in Australia and New Zealand (NZ), and trade marks attorneys in Australia. The Board is established under section 227A of the Patents Act 1990 (Cth) (the Patents Act), and consists of:
* a Chairperson (rotating between a person from Australia and a person from NZ);
* the Director General of IP Australia;
* the NZ Commissioner of Patents;
* at least 2 NZ representatives of the patent attorney profession; and
* between 2 and 5 other members.
The Trans-Tasman IP Attorney regulation regime, which covers patent attorneys in Australia and NZ, and trade mark attorneys in Australia, is an important mechanism of assuring the availability, quality, expertise and ethical standards of its members, who provide intellectual property (IP) advice and services to users of the IP system.
Board members are responsible for carrying out the Board's functions under the Patents Act including assessing the qualifications and knowledge required for registration as a Trans-Tasman patent attorney or Australian trade marks attorney, and maintaining the standards of professional conduct applicable to the profession. Board members are accountable to the Australian Minister for Industry and Science and the NZ Minister of Commerce and Consumer Affairs.
The Australian Government is seeking expressions of interest from persons who wish to be considered to serve on the Board as members. By setting the knowledge requirements and qualifications for professionals, accrediting relevant tertiary education providers and upholding ethical standards, the Board plays a crucial role in shaping the profession today and ensuring it can respond effectively to current challenges and emerging issues in the IP ecosystem.
The selection criteria
Legislative
To fully meet the Board's remit requires a diversity of perspectives and experience. The Australian Government is looking for individuals with
* substantial experience or knowledge; and
in at least one of the following fields:
* Australian patent attorney practice;
* Australian trade mark attorney practice;
* the regulation of persons engaged in a prescribed occupation;
* public administration;
Alternative backgrounds
Alternative backgrounds that may be considered include:
* the legal profession;
* the innovation, commercialisation and technology sectors that drive the IP system; and
* tertiary education accreditation and quality processes.
Capabilities
The Board members appointed through this process must be Australian residents and should have the following attributes:
* the ability to think strategically, analyse information and understand complex issues;
* the ability to make timely, principled and analytically robust decisions;
* the ability to work effectively as part of a team; and
* a high level of integrity and accountability.
Appointments
Board appointments are usually for 3 years and may be re-appointed for additional terms. The new members appointed through this process are likely to commence their terms in November 2025.
The Board meets 3 times per year—typically rotating, between Auckland, Brisbane, Melbourne, Sydney or Wellington—with each meeting lasting 2 to 3 days, including travel time. Board members will also be required to attend to various matters out-of-session, at an average of 1 hour per fortnight.
Remuneration
Board members are part-time public office holders and receive a sitting allowance set by the Remuneration Tribunal – currently A$995 per day for ordinary (non-Chairperson) members. Members are entitled to an allowance for travel-related expenses as determined by the Remuneration Tribunal.
