Overview

Principal Advisor - NSW Building Commission (Building Operations - Legal Operations). The role is based in Parramatta and is a temporary position to 30 June 2026, Grade: Clerk Grade 11/12. The NSW Building Commission NSW has been established to ensure the building industry meets standards and targets, and offers a dynamic environment focused on innovation, collaboration and career development.

This opportunity sits within the Disciplinary Action Unit, which manages the disciplinary process for Licence Holders in the Building Industry, including determinations on complex matters of fact and law and appropriate disciplinary actions.

Responsibilities

- Consider the most complex briefs of evidence and the oral and written submissions from licence holders and other affected parties.
- Recommend and determine disciplinary action through administrative decisions.
- Prepare Notices to Show Cause and draft decisions determining factual and legal matters and take appropriate disciplinary action.
- Collaborate with internal stakeholders (investigators, inspectors, mediators, legal officers) and external stakeholders (lawyers, tradespeople, consumers).
- Undertake and contribute to supervision, training and development of junior staff.
- Contribute to organisation-wide development and process improvement related to referrals, evidence collection and presentation, and ensuring procedural fairness.

What you will be doing

This role requires a legal professional with extensive experience in litigation, drafting or regulatory decision making, and an interest in regulatory law and practice. Demonstrated ability in statutory and factual analysis and drafting complex documents is essential.

Qualifications and Requirements

- Experience as a solicitor with the ability to resolve highly complex legal and factual issues and determine appropriate disciplinary actions, including drafting conditions to remedy misconduct and ensure legislative compliance (minimum 7 years).
- Strong analytical and drafting skills, knowledge of investigative processes and the application of evidence rules, and principles of procedural fairness and natural justice.
- Highly advanced written communication skills with the ability to express complex issues concisely and logically.
- Qualifications or experience related to building, surveying or planning are advantageous but not required.
