Principal Investigator

Certifier and Integrity Unit, Building Compliance, Building Commission NSW

Grade: Clerk Grade 9/10

Location: Parramatta

Term: Ongoing fulltime

About the team

Are you ready to make a meaningful contribution and help safeguard the integrity of NSW's building and development registered certifiers regulatory scheme under the Building and Development Certifiers Act 2018 (BDC Act). The Certifier & Integrity Unit exemplifies integrity, expertise and professionalism in undertaking audits and investigations of private certifiers and council certifiers. The audits and investigations ensure the public is protected from registered certifier misconduct and helps build public confidence in the NSW construction and housing industry.

About the role

An exciting opportunity has arisen within the Certifier & Integrity Unit, Building Compliance at Building Commission NSW, to undertake serious and complex audits and investigations of registered certifiers for misconduct and breaches of the certification legislation which includes the following Acts pr provisions of Acts and the regulations under those Acts:

· The BDC Act

· The Environmental Planning and Assessment Act 1979,

· Part 4 of the Strata Schemes Development Act 2015,

· Division 5 of Part 2 of the Swimming Pools Act 1992,

We audit and investigate registered building certifiers with the aim to:

* promote certifiers' obligations under the regulations
* ensure they adjust their behaviour after education or disciplinary actions
* reduce harm or loss to the community from non-compliance
* use a range of enforcement options if certifiers don't comply with the standards
* collect data about practices to improve regulation
* highlight important areas of practice for all certifiers.

Key requirements – to be successful you will have experience:

* Undertaking multiple complex investigations and or audits for regulatory compliance and conduct matters at the same time and completing investigation reports on time,
* Exercising legislative powers to investigate including obtaining, information, evidence, undertaking formal interviews and obtaining statements in compliance with rules of evidence and procedural fairness.
* Preparing high quality investigation reports to inform decision making and result in disciplinary action for misconduct or may lead to prosecution for criminal breaches.
* Prepare, oversee, and undertake complex compliance and investigation activities through the delivery of risk based regulatory programs to ensure and enhance compliance
* Supervise, lead, and conduct proactive compliance operations to educate licence holders and traders on their rights and obligations to ensure compliance
* Provide expert advice to internal and external customers and stakeholders to maximise regulatory outcomes and reduce negative impact on customers
* Advise customers on investigation outcomes to ensure they are informed of action being taken
* Maintain up-to-date knowledge and understanding of relevant legislation, policy, and procedure to demonstrate exemplary regulatory practice to the NSW community
* Gather and review evidence and prepare and maintain accountable records, documents, submissions and reports to recommend appropriate action to decision makers and ensure recording keeping and legislative requirements are met
* Provide coaching and mentoring in the ongoing development of team members to build capability to deliver innovative regulatory services and ensure all regulatory activities are undertaken for the protection of the NSW community
* Provide expert advice to senior managers regarding significant developments and options for meeting regulatory compliance objectives and contributing to business planning and performance

Key challenges

* Understanding the legislative role of registered certifiers under the certification legislation
* Identifying risks and reacting quickly to changing situations when engaging with customers and stakeholders on site while ensuring the safety of yourself and others
* Presenting education and assistance which is consistent with legislation, policy and procedures in a way licence holder and traders can understand given their varying levels of knowledge, needs and diversity of business
* Balancing the support and needs of the team as a people leader while undertaking own complex compliance activities in an agile working environment

Essential requirements:

· Substantial demonstrated experience in the formal conduct of investigations or audits of registered certifiers or similar investigations

* Knowledge of the functions of an investigator and auditor under the BDC Act.
* Certificate IV in Government Investigations or agreement to obtain the Certificate IV or a qualification considered to be equivalent by Building Commission NSW.
