**About the NDIS Quality and Safeguards Commission**

The NDIS Quality and Safeguards Commission (the NDIS Commission) is an independent

agency established on 1 July 2018 to improve the quality and safety of NDIS supports and

services. The NDIS Commission is the dedicated national regulator of NDIS service providers

in Australia and a non-corporate entity under the Public Governance, Performance and

Accountability Act 2013.

**The NDIS Commission's core legislative functions**
- Uphold the rights of, and promote the health, safety, and wellbeing of, people

with
- disability receiving supports or services, including those received under the NDIS.
- Develop a nationally consistent approach to managing quality and safeguards for

**About the Division**

The Regulatory Operations Division (the Division) delivers core regulatory functions including

registration of NDIS providers, oversight of the Approved Quality Auditor (AQA) scheme,

oversight of the national worker screening arrangements, compliance monitoring and

enforcement. It is also responsible for the delivery of targeted regulatory campaigns, risk and

intelligence, operational policy, quality improvement, Indigenous and Remote Operations

and has a small team undertaking an operational assurance and review function.

The Division has four branches and a small office supporting the Deputy Commissioner:

- Market Operations
- Regulatory Campaigns and Projects
- Compliance and Enforcement
- Operational Assessment

**About the branches**

Market Operations
The Market Operations Branch oversees the registration, worker screening and Approved

Quality Auditor (AQA) functions of the NDIS Commission and ensures provider and worker

obligations are understood. Market entry decision making is supported by stakeholder

engagement and intelligence, risk, and data analysis. The Branch is also responsible for

administration of the NDIS Worker Screening Database. Finally, the Branch leads inter
- agency engagement for market entry and worker screening operations.

**Regulatory Campaigns and Projects**
The Regulatory Campaigns and Project Branch delivers timely targeted regulatory initiatives

to promote compliance and continuous improvement amongst NDIS providers. Broad

variety of teams including taskforce, operational policy, campaigns, high intensity and special

projects supports a flexible approach to responding to issues with a targeted and risk
- responsive regulatory approach.

**Compliance and Enforcement**
The Compliance and Enforcement Branch is responsible for delivery of compliance

monitoring and enforcement of providers and workers in the NDIS. It applies a risk
- responsive approach to its regulatory activities using proactive and reactive levers to ensure

compliance, quality providers and workers and safeguarding of participants. It is responsible

for leading investigations and taking appropriate and proportionate action in response to

non-compliance. It has a key role developing relationships with other regulators and
