Job Description

The Commercial Manager plays a pivotal role in identifying commercial risks, resolving contractual issues, and supporting project operations teams with financial and contractual management.

This position is crucial in protecting KONE's financial interests, recognizing commercial opportunities, and ensuring robust commercial governance in projects.

1. Contract & Commercial Management
* Protect KONE's financial and commercial interests with clients, subcontractors, and suppliers to achieve business objectives.
* Conduct thorough risk assessments of contractual and commercial risks and recommend appropriate actions.
* Review client contract terms during bidding and execution phases, identifying obligations, proposing revisions, and ensuring KONE's rights are fully protected.
* E nsure consistent application and compliance with contractual obligations, including issuing notifications, managing claims, presenting payment requests, and negotiating contract variations.
* Collaborate with project teams to manage disputes, limit potential liabilities, and negotiate with clients when necessary.
* Support project closure activities, including final review, delivery requirements, and dispute resolution regarding payments.
2. Financial & Operational Support
* Promptly process payments and implement strategies to mitigate debt risks.
* Analyze overdue accounts, lead review meetings, and coordinate recovery actions.
* Monitor internal credit risk evaluations (traffic light process) and communicate changes for CRM updates.
* Communicate with clients and internal teams to resolve significant payment delays, negotiate complex terms, and support compensation and resolution agreements.
3. Bids & Business Development
* Support tendering teams in preparing precise and competitive bids.
* Collaborate with departments to develop consistent and compliant projects.
* Identify potential commercial opportunities through commercial insights and project interactions.
4. Legal & Compliance
* Administer and coordinate bonus calls and legal cases related to collections with external law firms.
* Work with the legal team to analyze changes in laws, regulations, and contractual trends, advising on their impact on the company.
* Ensure all stakeholders understand contractual obligations and financial implications.
5. Coaching & Internal Support
* Provide training and guidance to employees on optimal commercial practices and contract management.
* Support project teams with daily commercial and contractual activities.


Required Skills and Qualifications

* Degree from a reputable university.
* Minimum 10 years' relevant experience in the construction industry.
* Excellent knowledge of project operations, financial processes, and contract management.
* Solid financial knowledge with ability to interpret contractual financial data and take corrective measures.
* Exceptional analytical skills, identifying trends and root causes.
* Advanced commercial skills, exceptional negotiation and communication skills.
* Solid contractual knowledge and familiarity with construction processes.
* Solid understanding of local laws and regulations.
* Experience in preparing, negotiating, and managing contracts.
* Fluent English language skills.
* Competent in Microsoft Office, particularly Excel, Word, and PowerPoint.
