The Commercial Manager is responsible for the end‐to‐end commercial management of large strategic contracts, both upstream with customers and downstream with Balance of Plant (BoP) subcontractors. This role ensures alignment with Fluence's commercial standards, compliance with regulatory obligations, and effective commercial delivery across major BESS projects.
Working closely with project, legal, engineering, and procurement teams, this position drives contractual performance, manages commercial risk, and supports the successful execution of projects ranging from long‐term service agreements to full turnkey EPC contracts valued between $50M and $250M AUD.
Responsibilities
* Manage the commercial execution of customer head contracts, ensuring all contractual obligations, notices, milestones, and entitlements are proactively managed.
* Serve as a key commercial interface with customers, supporting negotiations, variations, claims, and dispute resolution.
* Lead commercial strategies to preserve Fluence's rights and maximise contractual outcomes.
Downstream – Subcontractor & BoP Contract Management
* Govern the commercial performance of subcontractors, ensuring flow‐down of head contract obligations and back‐to‐back risk alignment.
* Manage subcontract negotiations, variations, claims, and commercial communications.
* Oversee subcontract execution to ensure compliance, delivery performance, and cost management.
Cross‐Functional Commercial Governance
* Collaborate closely with project teams, legal, engineering, sales, and procurement to ensure consistent commercial standards.
* Identify, assess, and proactively manage commercial risks and opportunities across the project lifecycle.
* Support dispute resolution processes across customer and subcontractor interfaces.
* Build and maintain strong commercial relationships with internal and external stakeholders.
* Domestic travel as required.
Requirements
* Bachelor's degree in Business, Law, Finance, Engineering, Construction Management, or a related discipline.
* Experience managing large‐scale projects or complex commercial contracts within energy, infrastructure, engineering, or construction sectors.
* Demonstrated capability in contract management for EPC, D&C, or LTSA agreements.
* Proven experience in commercial negotiation and risk management.
* Strong project management understanding and commercial governance capability.
* Ability to engage effectively with senior stakeholders and cross‐functional teams.
* Strong financial and analytical skills, including commercial reporting and cost/impact analysis.
